1.2 Definitions
- Affiliate/Referral Agent: Individuals or entities promoting our courses in exchange for a 40% commission per sale.
- The Company, We, Us, or Our: Refers to The Au Pair Club.
- Country: Refers to any country globally, as our services are virtual.
- Device: Any technology used to access the Service, such as a computer, phone, or tablet.
- Service: Refers to the website and all related offerings, including childcare profiles, job portal, courses, and community access.
- Terms and Conditions (or “Terms”): The agreement governing your use of the Service.
- Third-party Social Media Service: External platforms or services that may display content or be integrated with our Service.
- Website: The Au Pair Club, accessible at https://theaupairclub.com.
- You: The person or entity accessing or using the Service.
2. Acknowledgement
These Terms govern your use of the Service and define the relationship between You and The Company.

4. Childcare Profiles and Job Portal
The Au Pair Club facilitates connections between families and au pairs. By using these features, you agree to the following:
4.1 Membership and Fees
- Au Pair Profiles: Free to create and use.
- Family Profiles: Require a one-time registration fee and a recurring monthly subscription. These fees are non-refundable and cover access to job listings, community resources, and features.
4.2 No Guarantee of Matches
We do not guarantee successful matches, placements, or any specific outcomes.
Success depends on your:
- Profile quality and completeness.
- Effort and engagement with the platform.
- Realistic expectations regarding opportunities.
4.3 Prohibition of Agencies and Competitors
Agencies and competitors are not allowed to use the platform unless part of our Partnership Programme. Violators will face a penalty of R20,000 (Twenty Thousand Rand) per violation and potential legal action.
5. Monitoring and Safety
The Au Pair Club is committed to fostering a safe and respectful community.
5.1 Monitoring Content
We actively monitor profiles, comments, and interactions to ensure they align with our policies. Harmful or inappropriate content may be edited, removed, or restricted.
5.2 Reporting Issues
You are encouraged to:
- Report inappropriate content or users via our job portal or support channels.
- Flag concerns about rule violations or harmful behaviour.
5.3 Our Liability
While we strive to monitor all content, we cannot guarantee the immediate removal of every inappropriate item. The Company is not liable for user-generated content.
5.4 Proud Track Record
To date, The Au Pair Club has received zero reports of misconduct or user suspensions, reflecting our commitment to maintaining a respectful platform.
6. Refund Policy
Refunds depend on the type of service or product purchased:
6.1 Online Courses
Refunds are available within 14 days of purchase, provided:
- Less than 25% of the course content has been completed.
- The course has not been shared, copied, or distributed.
- Technical issues (e.g., server outages) prevented you from accessing the course effectively.
Refunds are not available if the course:
- Was purchased more than 14 days ago.
- Was purchased using a discount code (partial refunds may apply).
- Was not completed due to personal issues like financial difficulties or device problems.
6.2 Childcare Profiles and Subscriptions
Refunds are not provided for:
- One-time registration fees for family profiles.
- Monthly subscriptions, even if no suitable match is found.

7. User Conduct and Termination
Your behaviour must align with our standards.
We reserve the right to suspend or terminate your account if you:
- Engage in abusive, harassing, or discriminatory behaviour.
- Provide false or misleading information in your profile.
- Post content that violates the rights of others or infringes on our policies.
- Damage the platform’s integrity or harm other users.
If terminated, you will lose access to the Service and will not receive a refund for any fees paid.
8. Limitation of Liability
We are not responsible for:
- Loss of data, income, or privacy.
- Service interruptions caused by factors beyond our control.
- Any damages resulting from the use or inability to use the Service.
Our total liability is limited to the amount you paid for the Service.
9. “AS IS” Disclaimer
The Service is provided “AS IS” and “AS AVAILABLE” without any guarantees or warranties. We do not promise the Service will be free from errors, uninterrupted, or meet all your expectations.
10. Governing Law
These Terms are governed by South African law. Any disputes will be resolved exclusively in South African courts.
